Representation in r/o Relaxation for Promotion to the Grade of Inspector.

Sub : Granting relaxation for promotion to the grade of Inspector-reg.
A re-structuring in CBEC formations is underway both cadre strength of all categories of officers/staff having been allocated vide Board’s letter F.No. A.11019/08/2013-Ad.IV dated 01.08.2014.
2. Consequent upon such revision in the cadre strength, 119 Inspectors would be considered for promotion to the Grade of Superintendent. As a result, 119 posts of Inspectors would fall vacant which would have to be filled up by Direct recruitment and Promotion from feeder cadre i.e. Sr. Tax Assistant (Now-EA) in the ratio of 66.66% : 33.33% as per Recruitment Rules as the Ministry of Finance notification dated 29.11.2002. Thus, of the 119 posts of Inspectors which would full vacant due to promotions, 79 posts would be required to be filled up by direct recruitment and 40 posts would be filled up by promotion from feeder cadre.

3. It would be pertinent to mention here that though ample vacancies are existing in the promotee quota of Inspector, the same cannot be filled up for want of eligible officers as per the provisions incorporated in the Recruitment Rule of Inspector.

4. Prior to cadre restructuring, Lower Division Clerks with 11 years service in the grade and 2 years as UDC were eligible for promotion to the grade of Inspector. On a similar analogy, Lower Division Clerks who have put in nearly 10 years service were granted deemed promotion to the grade of Tax Assistant during the year 2003, consequent upon which they have been working as Tax Assistant for more than 6 years, thus taking the total span of service to 16 years.

Considering the fact that the CCA(Cadre Controlling Authority) is required to meet the growing demands of the user-clients for much higher levels of facilitation, reliance on technology and having a motivated, committed and trained workforce, for which massive exercise of reorganization is being embarked upon by the Board, the said objectives obviously cannot be met with, by having a workforce which is low in morale and deprived of opportunities for a proper career building.

          6. As per the Recruitment Rules for promotion in the grade of Inspectors, Two (02) years regular service in the Grade of Sr. Tax Assistant of Central Excise.
7. In the Central Excise Ranchi Zone (CCA), it is seen that not many eligible candidate would be available for consideration for promotion to the grade of Inspectors and such posts would remain vacant which would hamper work as much of the work load is shouldered by the Inspector grade and shortage in the grade would seriously hamper the work.
8. The Tax Assistant of Central Excise Ranchi Zone, Patna were promoted to the grade of Sr. Tax Assistant vide Estt. Order No. 22/2013 dated 30.04.2013. Thus, for these Sr. Tax Assistants to be eligible for promotion to the grade of Inspectors, they would have to wait till April, 2015 which is nearby 06 months ahead from now.
9. It is reliably learnt that all the DPCs for promotion to various grades are to be completed by 30th September, 2014 and the new formation would start functioning from October, 2014 as per the proposal and the road-map in this regard.
10. Thus, it is humbly prayed that the eligibility condition for promotion to the grade of Inspectors may be relaxed in terms of Rule 6 of the Recruitment Rule, 2002 for the grade of Senior Tax Assistants, so as not to keep the posts of Inspectors through promotion remaining vacant for so long, as a onetime measure in keeping with the exigency & special circumstances under which restructuring in CBEC is to be implemented.
11. Since appointment in the grade of Inspectors through direct recruitment is a lengthy process which would take considerable time before the batches being to join, by keeping the posts through promoting also vacant for 6-8 months would not only aggravate problem but also creating serious difficulties at field level.
12. Alternatively, ad-hoc promotion to the grade of Inspector may be considered for the 40 posts in Central Excise Ranchi Zone (CCA) in absence of sufficient number of candidates from the feeder cadre, which could be regularized by April 2015 when all the candidates would attain the eligibility criteria.
It is requested that the DPC for promotion to the grade of Inspectors may be conducted by considering the names of STA’s who would complete 2 years in the grade by April 2015. Hoping that the CCO (Ranchi zone Patna) would consider the genuine submissions put forth by this Association and anticipating relaxation for its members before the advent of reorganization and introduction of GST, thereby boosting the morale of many officers in the Department.
